01Agreement to these terms

metabole.tech is operated by Cubizor LLC, a limited liability company formed in the State of Delaware, United States, trading as Metabole. In these terms, we, us and our mean Cubizor LLC; you means anyone using the site.

By using the site you accept these terms. If you do not accept them, please do not use the site.

02Nothing here is an offer

What we publish about our work, our capabilities and our approach is published for information. It is not an offer, a quote, a proposal or a commitment of any kind, and it is not professional advice to act on without talking to us first.

Reading this site, sending an inquiry through the contact form, and receiving our automated acknowledgement create no client relationship, no contract and no obligation on either side. We take on work only under a separate written agreement signed by both parties.

03How you may use the site

You may read the site, and print or save pages from it, for your own personal or internal business use.

You may not use the site to break any law; attempt to gain unauthorised access to it or to any system connected to it; probe, scan or test its security without our written permission; interfere with its operation or with anyone else's use of it; collect its content by automated means at a rate that burdens it; or misrepresent who you are or who you act for.

04The contact form

What you send through the form must be yours to send, must be accurate, and must not be unlawful, threatening, defamatory, or another person's confidential information.

Do not use the form for advertising, mass mail or solicitation. Submissions are rate limited, and we may ignore, delete or block any of them for any reason. We are under no obligation to reply to an inquiry, and nothing on this site promises that we will.

05Intellectual property

The site and everything in it, including the text, the design, the layout, the typography, the code, the images and the Metabole name and logo, belongs to Cubizor LLC or is used under licence, and is protected by United States and international intellectual property law.

Your right to use the site transfers none of that ownership. You may not copy, republish, distribute, sell, licence or create derivative works from any part of it without our written permission. Client names and marks shown in our work belong to their owners and appear with their permission.

06Links to other sites

The site links to places we do not control, among them GitHub and LinkedIn. Those links are a convenience. We do not endorse those sites, we are not responsible for their content or for how they handle your information, and visiting them is at your own risk.

07Disclaimer

The site is provided as is and as available, without warranty of any kind, express or implied. To the fullest extent the law permits, we disclaim every warranty, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.

We do not warrant that the site will always be reachable, that it will be free of errors, or that anything on it is complete or current.

08Limitation of liability

To the fullest extent the law permits, neither Cubizor LLC nor its members, officers, employees or contractors will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of profits, revenue, data, business or goodwill, arising out of or connected with your use of, or inability to use, the site. This holds whether the claim is brought in contract, in tort or on any other basis, and even if we were told such damages were possible.

Our total liability for all claims relating to the site will not exceed one hundred United States dollars (USD 100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is so, the exclusions and limits above apply to you only as far as the law allows.

09Indemnity

You agree to indemnify Cubizor LLC and its members, officers, employees and contractors, and to hold them harmless, against any claim, loss, liability or expense, including reasonable legal fees, arising out of your use of the site or your breach of these terms.

10Privacy

Our Privacy Policy sets out what the site collects and what we do with it. It forms part of these terms, and by using the site you accept it too.

11Changes to these terms

We may revise these terms as the site changes. The date at the top of this page always reflects the current version. Using the site after a revision means you accept the revised terms.

12Governing law and jurisdiction

These terms, and any dispute arising out of them or out of the site, are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules.

The state and federal courts sitting in New Castle County, Delaware have exclusive jurisdiction over any such dispute, and you consent to the personal jurisdiction and the venue of those courts.

13Severability and entire agreement

If any provision of these terms is found unenforceable, it is to be narrowed or removed to the smallest extent necessary, and the rest stays in force. Our failure to enforce a provision is not a waiver of it.

These terms and the Privacy Policy are the entire agreement between you and Cubizor LLC concerning this website. They govern no engagement for services, which is covered by its own signed contract.

14Language

These terms are published in English and in Turkish. The English version is the authoritative one: where the two differ, the English version governs.
